Clarify on endless battle clause

In Noam Chomsky's post, endless battle clause was updated to include Leppa+recycle, but I've been using it for ever. However, sometimes Leppa+recycle+fling auto disqualifies me and sometimes it doesn't. I'm curious to know what triggers and doesn't trigger the clause.
